Terms
Last updated 4 September 2026.
The agreement between you and us. Written in English rather than in the usual dialect, because you are about to trust this with something that matters and you should be able to read what you are agreeing to.
Who “we” is
Farewell Notes is operated by Qualeto LLC, a limited liability company in Volusia County, Florida, United States (“Qualeto”, “we”, “us”). Every “we” below means Qualeto LLC. It is Qualeto LLC you are contracting with, Qualeto that holds what you write, and Qualeto that appears on your bank statement if you pay for the unlimited tier.
In short
- This is not a will and carries no legal weight.
- We cannot guarantee delivery. Email fails. Read on.
- We will never open your notes because somebody asked us to.
- Paid means paid once, for as long as this exists.
- If we ever close, you get everything back first, with notice.
- You must be 18 or over.
The rest is detail on those.
1. This is not a will
Nothing you write here directs your estate, appoints anybody, transfers property, or has any legal effect on what happens to your things. It is a way to leave words. If a note here contradicts your will, the will governs and this does not.
We are not lawyers and nothing on this site is legal advice. If you want your wishes to bind anybody, see one. Please do not use a letter here in place of one.
2. What we promise, and what we cannot
We will make a genuine, careful effort to keep your content safe and to deliver it when you have said it should be delivered. We have built this to fail safe: drafts are never sent, a wrong click is reversible, and nothing opens without either you, somebody you named, or a timer you turned on yourself.
We cannot promise it will arrive. Specifically:
- Email is filtered as spam, and addresses go stale over years.
- Servers fail, and providers close accounts.
- The check-in timer depends on a scheduled job. If that job stops we will warn you in your account, but a timer is not a guarantee.
- People forget. If nobody knows this exists, nothing here can make them look. Tell somebody. Naming a keeper and telling them what you have asked of them is the single most useful thing you can do.
Please do not rely on this as the only route by which something important reaches somebody.
3. What we will not do
We will not open an account’s notes on request. Not for a relative, not for an executor, not for somebody with a death certificate. We have no reliable way to verify any of it, and releasing somebody’s private letters while they are alive is not a mistake that can be undone.
The only things that open an account are: the account holder, a keeper they named, and a timer they turned on. If you want a human to be able to make that call, name a keeper.
We will not read your letters as a matter of course, or use them to train anything, or sell them, or show them to anybody you did not name. What we can technically see is set out honestly in the privacy notice.
4. Your side of it
- You must be 18 or over.
- Give accurate email addresses. A letter addressed to a typo reaches nobody, and we cannot detect that for you.
- Do not store live credentials — passwords, card numbers, account numbers, recovery codes. The database is not encrypted against us, and this is said plainly in the app where you write. Record where things are and who to ask.
- Do not use this to harass, threaten or abuse anybody, to break the law, or to store material that is illegal to possess. Somebody being written to can ask us to remove their address, and we will.
- Keep your own sign-in details to yourself.
If you use this to do serious harm to somebody, we may suspend the account. We will not do that over a disagreement about taste — grief is not tidy, and a letter that is angry is still a letter.
5. Paying
The free tier is a real product, permanently free, with every safety feature included. It limits how many people and messages you can have, and nothing else.
The paid tier is pay what you want, from $1.00, paid once. It removes the limits for as long as this service exists. There is no subscription and no renewal, because a lapsed card should not be able to delete somebody’s letters to their children.
Payments are handled by Stripe. If you change your mind, write to us within 30 days and we will refund you; you keep whatever you have written and drop back to the free limits for new material.
“For as long as this service exists” means what it says. It is not a promise that the service is immortal — it is a promise that we will not charge you again, and that section 6 applies if it ever ends.
6. If this service ever closes
Every service can end, and a product about mortality should say what happens when it does rather than pretend otherwise. If we decide to close, or cannot continue:
- We will give at least 90 days’ notice, by email, to every account holder and to every keeper.
- We will provide a way to export everything — your letters, your notes, and your list of people — in a format you can read without us. That already exists and you can use it today: it is on your account, and the people you have written to can save their own copy the same way. We would rather you did not have to take our word for this one.
- Where we reasonably can, we will publish the software so that somebody technical can run it themselves.
- We will not open anybody’s sealed notes on the way out, and we will not sell your content to anybody. If the service is transferred, it goes with these terms attached.
7. Ending it yourself
You can delete your account at any time. That deletes your letters, your notes, your list of people and your log, and it cannot be undone. The people you had written to lose their access at the same moment.
If you simply stop using it, nothing happens. Your notes stay sealed. Free accounts are not deleted for inactivity — an account that has sat untouched for nine years is this product working correctly, not a dormant user to be cleaned up.
8. Liability
We provide this carefully but as it is, without warranties beyond those the law gives you and that cannot be excluded.
To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the greater of the amount you have paid us or $50.00. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
We say this plainly: if a letter does not arrive, we will be genuinely sorry, and we will not be able to compensate you for it. That is the honest position, and it is why section 2 asks you not to rely on this alone.
9. Changes
If we change these terms in a way that materially affects you, we will email you at least 30 days beforehand. If you do not accept the change you may close your account and, if you paid within the previous year, ask for a refund.
10. Law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute goes to the state or federal courts located in Volusia County, Florida, and by using this you agree to those courts hearing it.
That is subject to one thing: if you live somewhere whose law gives you rights that cannot be signed away — as consumer protection law in the UK, the EU and elsewhere does — you keep them, and you may bring proceedings where that law says you may. Nothing here is meant to take away a protection your own country gives you.
